I am writing to follow up on my previous reports regarding the accumulation of business waste at 7 Dartmouth Road, which continues to attract fly tippers.
This waste appears to originate from the adjacent car park, which I understand is leased by a private parking operator, and from the neighbouring business, which I understand is currently in administration. Regardless of the business's financial status, there is also a freeholder who retains legal responsibilities for the property.
I have now reported this issue twice, yet the waste remains. I would be grateful if you could confirm:
Who the council considers legally responsible for removing the waste.
What enforcement action has been taken or is proposed against the responsible party or parties.
If the council considers that the leaseholder, freeholder, or any other party has obligations under environmental legislation to prevent or remove the accumulation of waste.
The continued presence of this waste is affecting the local residents on Dartmouth road  and is creating an ongoing environmental nuisance. If the council does not consider itself responsible for removing the waste, please explain the legal basis for that decision and advise what further action you intend to take against those who are responsible.

 I contacted Falco asking them to clean the rubbish inside the shed and they said:

The Falco contract with the London borough of Lewisham is to check the functionality of the unit, door and lock but does not include cleaning.
 

You will need to contact the council’s road cleaning team regarding this issue.

Could please let me when you are coming to clean it so I can open the shed, so the inside can cleaned as well?

General dumping ground for David’s Road and rear of Devonshire Road. Multiple bins for flats above where no bins can be stored and bags should be provided but are not! So anyone and everyone just dumps their rubbish on or next to existing bins or just outside anyone’s rear entrance!
