I am writing further to my previous correspondence regarding the large tree situated on your property at Harney Court Estate, Ommaney Road SE14 5NS, which continues to overhang into my garden at 13 Ommaney Road. As I received no response to earlier letters, my neighbour and I arranged and paid for a qualified tree surgeon to cut back the branches that could be safely reached from my side of the boundary (invoice attached). However, this work was not sufficient, as the tree surgeon was unable to access the Carney Court side of the property to fully remove the large, overhanging limbs. These remaining branches are leaning against and damaging my boundary fence, which is now at serious risk of collapse. Under common law, a landowner is responsible for ensuring that vegetation on their property does not encroach upon or cause damage to a neighbour’s land (Lemon v Webb [1894]; Mills v Brooker [1919]). Permitting a tree to cause physical damage amounts to a private nuisance, and ongoing inaction may expose the owner to liability for damages (Sedleigh-Denfield v O’Callaghan [1940]). I therefore request that you arrange for the remaining large overhanging branches see image blue & red mark to be cut back to the boundary line as a matter of urgency and take appropriate steps to prevent further damage to my fence. I am writing to request an urgent inspection of the large tree located directly behind my property at 66a Priestfield se23 2rs, as it is now posing significant risks to both my home and the surrounding properties. The tree has grown far too large for a residential area, and its size is already causing several serious issues: • Structural damage: Cracks and signs of subsidence have appeared in nearby properties which have been repaired in recent years, which we believe are being caused or worsened by the tree’s root system. • Overhanging branches: Large branches extend over our garden and roof, creating a safety hazard and increasing the risk of damage during high winds. • Blocked guttering: The overhang is causing persistent gutter blockages, leading to water overflow and potential damp issues. • Future risk: Given the tree’s rapid growth and current impact, it is highly likely that the damage will continue to worsen if no action is taken. I would also like to note that several small oak saplings are already growing naturally along this boundary. These young trees would, in time, replace the existing one without the need for additional planting. Additionally, I am aware that similar trees in the local area have been removed in recent years due to the risks they posed, which suggests this species may be prone to issues in residential settings. For these reasons, I kindly request that the council carry out a formal assessment and consider removing the tree to prevent further structural and safety problems. Hi. The Deptford Wharf and Enterprise Way use to be swept by the estate team. This has now been took over by the street cleansing team. This area has not been completed. The area hasn't been swept for weeks and all the litter bins are over flowing. Can you arrange for this area to be done and maintained on a regular basis.
